Terms & Conditions

1. Our Commitment To You

  1. Upon receipt of your signed client/registration form and registration fee, we undertake to work with you to find a suitable property for you to purchase/rent as per your instructions.
  2. Without prejudice to the generality of the foregoing sub-clause (a) we undertake to do the following
    1. take your detailed instructions on your requirements and bear these in mind in introducing a property
    2. search for introductory properties from various sources including but not limited to estate agent contacts, internet websites, local builders and developers and our own personal contacts on the Island
    3. inspect and make relevant notes on any potential introductory property
    4. compile a short list of introductory properties
    5. supply regular progress reports on potentially suitable properties
    6. accompany you on viewings of short listed properties
    7. if required negotiate with agents or potential vendors on such matters as purchase price of the property, purchase of chattels and fittings, dates of exchange of contracts and completion
    8. Monitor your purchase up to completion by liaising with agents, vendors and other relevant parties and keep you fully informed

2. Fees

  1. There is an initial non-refundable registration fee of £350.00 deductible from success fee. No VAT is currently charged.
  2. Our success fee is 1% of the purchase price for any property you exchange contracts to purchase, or 1 month's rent in respect of any property you agree to rent during the continuance or within 1 year after the date of termination or expiry of this agreement.

3. Interpretation

  1. For the purposes of this agreement, we shall be deemed to have introduced a property to you if, you have either received the particulars of a property from ourselves, directly or indirectly, or from any of the firms of Estate Agents with whom we have regular contact or through Agents or an individual whom you have instructed us to negotiate with on your behalf.
  2. For the avoidance of doubt you will be responsible for our success fee in any of the following circumstances where an introductory property is not purchased or rented in your name
    1. where such a property is purchased or rented by a relative or member of your family or business associate or nominee or trustee or body corporate I which you have a beneficial interest or of which you are a member;
    2. where such a property is purchased or rented by a third party and you enter into occupation, either exclusive, shared or in part, for any period whatever within one year of completion of the purchase or renting

4. Payment

Other than the Registration Fee, fees shall be made payable in full at either exchange of contract for purchase of property or on signing of lease for rental property. We reserve the right to charge interest on any sums not paid on the due date at a rate of 4% per annum above base rate of Barclays Bank Plc.

5. Term

This agreement shall subsist for an initial period of 26 weeks and shall continue thereafter until terminated by 1 months' notice given in writing by either party to the other. (For the purposes of this agreement this will include notice given by email). If this agreement continues beyond the initial period of 26 weeks, we reserve the right to charge a further registration fee, but if we do so, then the fee payable upon exchange of contracts under paragraph 2 (b) will be reduced by any such additional registration fee.

6. General

The details of properties including, valuations, reports and other information which we may provide, are prepared in good faith and are solely for guidance purposes only. They do not form any part of any contract relating to the purchase or letting of any property. We strongly recommend that all purchasers and/or tenants must satisfy themselves as to the correctness and accuracy of any details provided by us.

7. Liability

In addition, we do not accept liability for the views of, or contents of any report prepared by, any third party in relation to any property. It is strongly recommended that all prospective purchasers and/or tenants take appropriate legal and other advice and use the services of relevant legal property and valuation specialists. Our service is not intended as a substitute to obtain such advice and accordingly no liability is accepted for any defects in legal title or in the fabric or construction of any property. This contract shall be governed by English Law and the parties submit to the exclusive jurisdiction of the English Court.

8. Data Protection

I understand and agree that Isle of Wight Homesearch may use my personal information provided during the period of this agreement and may disclose my information to vendors and other intermediaries or agents in order to provide a property search and acquisition service. I have a right to ask for a copy of my information and to correct any inaccuracies in the data.
